The following Terms and Conditions govern your use of our services at Bidshotwireless.com. By using the services of Bidshotwireless.com, you are deemed to have accepted these Terms and Conditions. Posting the amended terms may amend these Terms and Conditions on our site and such amendments shall become immediately effective.
USER AGREEMENT
This user agreement ("agreement") is a legal agreement between you, the individual user of Bidshotwireless.com ("user") and Bidshot Wireless Services, Inc. (BWS, Inc.), a Philippine corporation, the owner and operator of Bidshotwireless.com ("Bidshotwireless.com or website") governing your rights and obligations arising out of or relating to your use of the website and services therein. Any reference made in this agreement to BWS, Inc., shall be deemed to include, its subsidiaries, successors, assignees, affiliates and any company that controls BWS, Inc., directly or indirectly, and any other subsidiary of such controlling company.
ACCEPTANCE OF TERMS AND CONDITIONS
Your access to or use of Bidshotwireless.com and its services shall be deemed your acceptance to be bound by all the Terms and Conditions of this agreement. If you do not fully agree with all the Terms and Conditions of this agreement, please refrain from accessing or using the website and its services.
BIDSHOTWIRELESS.COM SERVICES
Bidshotwireless.com is a web portal showcasing all community-based and content-based products of Bidshot Wireless Services, Inc. In terms of the mobile and SMS services, Bidshotwireless.com is not liable for any delay in delivery, and for any faults made by participating mobile carriers. Any and all properties available for the user in the website are all properties of BWS, Inc. and are therefore under local, national and international copyright laws.
CHANGE, INTERRUPTION OR TERMINATION OF SERVICE
Bidshotwireless.com reserves the right to modify, vary, alter or otherwise change any or all of its services and Terms and Conditions upon which they are provided without prior notice to Bidshotwireless.com users. Bidshotwireless.com shall in no event and to any extent whatsoever be held responsible for interruptions of services due to reasons beyond its reasonable control. Additionally, Bidshotwireless.com may without prior notice to its users go offline or otherwise be unavailable for necessary system maintenance and upkeep. Subject only to reimbursement for unearned fees, Bidshotwireless.com may, without prior notice to its users, terminate the provision of its services to its users.
BREACH
Without limiting other remedies, Bidshotwireless.com may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate a user's membership and refuse to provide services to the user: (a) if the user breaches any of the Terms and Conditions of use; (b) if Bidshotwireless.com is unable to verify or authenticate any information provided by the user; or (c) if Bidshotwireless.com believes that the user's actions may cause legal liability for the user, other users of Bidshotwireless.com.
INTELLECTUAL PROPERTY RIGHTS
The website, its services and any and all of its aspects, parts or components, or any combination or permutation of such aspects, parts and components, including but not limited to (1) text, (2) software, (3) photographs, (4) graphics, (5) page layout (6) design are the exclusive intellectual property of Bidshotwireless.com and are protected under intellectual property laws and treaties.
Such Content received through the Service may be displayed, reformatted, and printed by you for private, non-commercial use only and at all times used solely in connection with the Service in accordance with the Terms and Conditions.
LIMITATION OF LIABILITIES
Bidshotwireless.com will not be liable to any user or any third party for any and all damages, however classified or categorized, arising out of or related to the use or non-use, misuse, availability or reliance on the website and the services therein notwithstanding the fact that Bidshotwireless.com shall have been informed or notified of the possibility of the instance of such damages.
MEMBER CONDUCT
Bidshotwireless.com users guarantee that Service will not be used for any purpose that is unlawful or prohibited by these Terms and Conditions and notices.
These Terms and Conditions agree to all local, state, national and international laws and regulations. Thus, Bidshotwireless.com users agree to abide by all local, state, national and international laws and regulations applicable to the Service. 3. Pirate any and all Bidshotwireless.com content for personal or commercial use, which infringes all patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary right ('Rights') of Bidshotwireless.com and any party or infringes any intellectual property law or any other applicable law.
4. Distribute unsolicited or unauthorized advertising, promotional materials, 'junk mail', 'spam', 'chain letters', and the like.
5. Interfere with another user's enjoyment of the Service.
DISCLAIMER OF WARRANTIES
Bidshotwireless.com users understand that:
1. Use of the Service is at each one’s sole risk.

The Service is provided on an 'as is' and 'as available' basis and the warranties on the part of Bidshotwireless.com contained in the Terms and Conditions are given in place of and replace, exclude and extinguish all and every other condition or warranty whatsoever on the part of Bidshotwireless.com, written or oral, whether express or implied by statute, regulation, directive or any other legislative or administrative enactment, common law, trade usage, custom or otherwise to the full extent permitted by law. EXCEPT AS EXPRESSLY PROVIDED HEREIN, Bidshotwireless.com, EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND OR NATURE, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, REPRESENTATIONS, WARRANTIES AND CONDITIONS OF SATISFACTORY QUALITY, PERFORMANCE, MERCHANTABILITY, MERCHANTABLE QUALITY, DURABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USE OF TRADE.
3. Inaccuracies or typographical errors may occur in the information and content used in, or available through the Service.
4. Modifications are periodically added to the information contained within the Service and Bidshotwireless.com may make changes or improvements with the Service at any time.
5. No advice or information, whether oral or written, obtained by any user from Bidshotwireless.com or through the Service shall create any warranty not expressly stated in the Terms and Conditions.
Except as otherwise stated or provided in the Terms and Conditions, Bidshotwireless.com does NOT guarantee that:
1. The Service will meet members’ standards and requirements.
2. The Service will be uninterrupted or error-free, timely or secure.
3. Defects or errors will be corrected, or that the server that makes content available, are free of viruses or other harmful components, especially with regard to the transmission of mobile content over mobile carriers
4. The use of or the results of the use of the Service or the content made available as part of the Service will be correct, accurate, timely, or otherwise reliable.
INDEMNIFICATION
Users agree to indemnify, defend and hold harmless BWS, Inc., its affiliates, officers and employees from any claim, demand, or damage, including reasonable legal fees, asserted by any third party due to or arising out of your use of or conduct on the Service.
MODIFICATION AND TERMINATION OF THE SERVICE
Users agree that Bidshotwireless.com has the right to terminate a password or account, remove any content related to the Service, for any reason, including without limitation, if Bidshotwireless.com believes that the user has violated any of its Terms and Conditions and policies.
In relation, users acknowledge that in case of termination of the Service, Bidshotwireless.com may immediately terminate and delete users’ accounts, and all content and files associated with these accounts, as well as bar further access to these files and accounts, without prior notice, unless agreed in writing. Nonetheless, Bidshotwireless.com shall give fair notification for the termination or suspension of accounts, and therefore access to the service as well.
Users also agree that Bidshotwireless.com is not liable to any of its members and any third party regarding termination and suspension of accounts, access or modification to the Service.
